Sorry für die lange Antwortzeit.

Hiermit gebe ich dir die gewünschte Erklärung ab, mit der Spezifizierung, dass es sich damit lediglich um Daten auf dem Open Data Portal handelt. Da wir zurzeit in einer Pilotphase sind und wir nicht 100% über die Zukunft der Portale Bescheid wissen, kann ich dir die Erklärung nur für diese Portale abgeben.

For clarity and without limiting any other rights granted, with respect to any imagery the City of St.Gallen has released or releases in the future on their Open Data Portal (daten.stadt.sg.ch) under a CC BY license, the City of St.Gallen waives any and all conditions of the license that could conflict with or prohibit free and unencumbered use of that imagery to derive or extract data, including without limitation tracing and vector feature extraction, and/or to produce derivative vector datasets, in each case for purpose of contribution to OpenStreetMap, and the City of St.Gallen expressly disclaims any rights in, or use conditions on, such derived or extracted data.

Ist das für dich so in Ordnung? Oder brauchst du diese Erklärung in anderer Form, unterschrieben oder auf dem Open Data Portal selbst. Lass mich wissen, wie ich dir weiterhelfen kann.

Danke für das gute Gespräch letzte Woche.

Ich hatte ja kurz das Thema Luftbilder Stadt St. Gallen angesprochen, und tatsächlich sie sind via WMS zugänglich und mit CC BY lizenziert. Soweit so gut, danke.

Um allfällige Unklarheiten zu vermeiden, speziell da wir in der Schweiz seit April jetzt auch einen Lichtbildschutz haben, wäre es euch ev. möglich eine Erklärung  in der folgenden Art abzugeben?

Der Hintergrund ist, dass die typischer Nutzung in OSM die händische Vektorisierung von relevanten Geometrien und das ableiten von anderen Sachverhalten (Strassenspuren und ähnlichem ist) und wir so generierte Daten nicht mit einem DRM Verbot und andere CC BY Eigenheiten belasten wollen.
