I don't believe this guideline is tenable in its current form.
The ODbL collective database definition is by far not as restrictive as the current wording. While I would agree that using what is present in OSM to modify a third party dataset creates a derivative DB, doing the opposite should not impact the status of the third party dataset (the modified OSM derived data remains OSM derived in any case) and the status of a collective database consisting of it and the modified OSM data.
